Utah’s ESA & Fair Housing Framework
- Utah Fair Housing Act (Utah Code §57-21): Utah has its own comprehensive fair housing statute that explicitly prohibits disability-based housing discrimination. This means ESA accommodation requests are protected at both the state and federal level in the Beehive State.
- Utah Antidiscrimination & Labor Division (UALD): Operating under the Utah Labor Commission, UALD handles fair housing complaints throughout the state. If a landlord in Salt Lake, Provo, or anywhere along the Wasatch Front denies your ESA, this is where to file.
- All Pet Charges Waived: With valid ESA documentation, Utah landlords must eliminate pet deposits, monthly pet rent, and any pet-related surcharges. Your emotional support animal is not classified as a pet under fair housing law.

Utah ESA & PSD Owner Protections Explained
Whether you rent near the U of U campus, a Provo apartment close to BYU, or a townhouse in West Jordan — your landlord is legally prohibited from charging pet deposits, pet rent, or any pet surcharges for your ESA.
Utah apartments and HOAs often maintain breed restriction lists. But these rules don’t apply to emotional support animals — your ESA is protected no matter the breed, size, or weight.
