West Palm Beach: A County Ordinance on Top of State Law
Most Florida renters have one state agency to call when a housing provider refuses an animal. In Palm Beach County there is a second, local one, with its own ordinance and investigators. That, a county tag rule, and a lot of age-restricted housing are what make a West Palm Beach request different.
Two Layers of Local Protection
Palm Beach County is one of the Florida counties that adopted its own fair housing ordinance, enforced by county staff rather than by Tallahassee. It does not replace Florida Statute 760.27; it adds a place to take a complaint.
Florida Statute 760.27
The rulebook for emotional support animals in housing: what a provider may ask for, what it may not, and the ban on charging extra for the animal.
It applies in every Florida county, and the 2026 federal change did not alter a word of it.
Palm Beach County Fair Housing Ordinance
Enforced by the county's Office of Equal Opportunity, which either investigates a complaint itself or refers it to another agency.
Complaints must be filed within one year of the last act. There is no appeal inside the office from a no-cause finding, but court remains open.
Work Out Your Deadlines
Enter the date of the refusal, or of the last thing the housing provider did. Each route runs on its own clock from that day.
Deadlines count from the act, not from when you noticed it. File well before the last day; investigators need time too.
The County Tag
Licensing here is countywide rather than city by city, which keeps it simple once you know the rule.
Buy the renewal within 30 days of expiry, or a late fee is added. A housing provider may ask to see it under state law, so keep the receipt with your letter.
Age-Restricted Communities
Palm Beach County has a large share of 55-plus housing, and residents are often told the community is exempt from fair housing rules. It is only partly true.
Taking an Animal on Brightline
West Palm Beach sits on the Brightline line between Miami and Orlando. Its terms separate pets from service animals clearly.
Brightline classes emotional support and comfort animals as pets, welcome if they fit the carry-on rules. Check the current terms before you travel; fees and details are Brightline's to change.
Downtown, Outside the Front Door
Clematis Street and the waterfront are dog-friendly in spirit, but the law draws a firmer line than the patio tables suggest.
- Inside restaurants and shops, Florida's access law protects service animals: dogs or miniature horses trained for disability-related work.
- Staff may ask two things: whether the animal is needed because of a disability, and what work it is trained to do.
- A support animal has no right of entry. Outdoor seating that welcomes pets is the business's choice, not an obligation.
- Passing off a pet as a service animal is a second-degree misdemeanor in Florida, with 30 hours of community service.
Writing the Request
A good request here reads the same as anywhere in Florida, with one local addition: say which rules you are relying on.
Email the landlord or manager, and the association too if there is one. Keep the sent copy.
From a Florida-licensed or Florida-registered telehealth clinician, with no diagnosis in it.
Proof of licensing and vaccination, which a provider is entitled to ask for.
Name a reasonable date. Silence past it becomes part of your record.
