Protect Your Deposit at Both Ends
An assistance animal is an easy target for a contested deduction. Documentation at move-in is what defeats a claim at move-out.
- Photograph floors, baseboards and door frames, room by room
- Note existing scratches, stains and odours in writing
- Check the landlord's inspection report and add anything missing
- Keep a dated copy of the signed report
- Record the condition of carpet specifically
- Repeat the same photographs in the same order
- Deep-clean areas the animal used most
- Repair minor damage you caused before inspection
- Ask to be present for the final walk-through
- Give a forwarding address in writing for the deposit
How Deductions Tend to Be Judged
A landlord may charge for real damage. The question is always whether a mark is damage or the ordinary ageing of a home.
Light carpet traffic patterns, faded paint, minor scuffs from daily living. Generally not chargeable to any tenant.
Surface scratches on hardwood, some carpet staining. Photographs from move-in usually decide these.
Chewed door frames, torn screens, soaked or destroyed carpet. Deductible from your regular deposit.

Does an ESA letter waive the pet deposit in Virginia?
The approved accommodation is what removes pet charges. The letter supports the request; approval is what changes the ledger.
Can my landlord raise the regular deposit instead?
Raising a deposit specifically because of the assistance animal would be a pet charge in another form. The two-month cap applies to deposits generally.
Do apartments in Virginia waive pet fees for ESAs automatically?
Not automatically. You have to make the accommodation request and support it with documentation.
I already paid pet rent. Can I get it back?
Ask in writing for the charge to stop from the date of approval, and separately for amounts already collected. Many Virginia landlords will credit them.
Do pet fees apply to service dogs?
No. The same principle covers trained service animals in housing.
What if my landlord keeps the whole deposit?
You are entitled to an itemised list. Unsupported or excessive deductions can be challenged; move-in photographs are your best evidence.
