Virginia’s ESA Statutes & Legal Framework
- Virginia Fair Housing Law (Va. Code §36-96.3:1): Virginia is one of the few states with a statute specifically addressing assistance animals in housing. This section of the Virginia Fair Housing Law outlines what documentation landlords may request and explicitly protects ESA owners from discrimination.
- Virginia Fair Housing Office (VFHO): Under the Department of Professional and Occupational Regulation (DPOR), the VFHO investigates fair housing complaints statewide. If a property manager in Richmond, Arlington, or Virginia Beach refuses your ESA request, this office handles enforcement.
- All Pet-Related Fees Waived: Virginia landlords cannot impose pet deposits, pet rent, or any animal-related surcharge on tenants with valid ESA documentation. Your emotional support animal is not treated as a pet under fair housing law.
- Breed & Weight Restrictions Overridden: Whether your ESA is a large breed, a small breed, or a breed commonly restricted by Virginia properties — none of those pet policy restrictions apply when you hold a valid ESA letter.
