Charleston, the state capital, and Morgantown, home to WVU, are West Virginia’s two largest rental markets. In Charleston, neighborhoods like the East End, Kanawha City, and South Hills have active rental demand. In Morgantown, the Evansdale and Sunnyside areas near WVU fill up fast with students — and pet restrictions abound. An ESA letter means those no-pets policies don’t apply. West Virginia ESA & Housing Law Overview
- West Virginia Human Rights Act (WV Code §5-11): WV’s own civil rights statute prohibits housing discrimination based on disability. This gives Mountain State ESA owners an additional layer of state-level protection on top of the federal Fair Housing Act.
- WV Human Rights Commission (WVHRC): The state commission investigates and enforces fair housing complaints across all 55 West Virginia counties. If a landlord in Charleston, Huntington, or anywhere in WV refuses your ESA accommodation, the WVHRC is the appropriate state agency to contact.
- Pet Charges Completely Waived: WV landlords must eliminate pet deposits, monthly pet rent, and any animal-related surcharges for tenants with valid ESA documentation. Your emotional support animal is a reasonable accommodation — not a household pet.
- No Breed, Weight, or Size Limits: Properties across West Virginia that maintain breed restriction lists or weight caps for regular pets cannot enforce those rules against emotional support animals with proper documentation.

What Your WV ESA or PSD Letter Gives You
