Pennsylvania ESA & Housing Laws
- PA Human Relations Act (43 P.S. §951–963): Pennsylvania’s own civil rights law prohibits housing discrimination based on disability, providing state-level protection that reinforces and works alongside the federal Fair Housing Act for ESA and PSD owners.
- PA Human Relations Commission (PHRC): The PHRC investigates and enforces housing discrimination complaints statewide. If a landlord refuses your ESA accommodation, you can file a complaint with the PHRC or HUD.
- No Pet Fees for ESAs: Under both federal and Pennsylvania law, landlords cannot charge pet deposits, pet rent, or any additional fees for a valid emotional support animal — whether you’re in Philadelphia, Pittsburgh, or rural PA.
- No Breed or Size Limits: Breed bans, weight restrictions, and species limits in your lease do not apply to ESAs. Even buildings with strict "no pets" or breed-specific policies must accommodate your emotional support animal.
